Model Anti-discrimination Policy

I thought this might be helpful as a model anti-discrimination policy regarding Gender

Identity, Gender Expression and Sexual Orientation.

I see no reason why private companies could not model their policy on this, as well

as public agencies. There may be better out there, but this one is pretty good.

Sexual orientation refers to whether a person is romantically or sexually

attracted to other adults of a different sex (as is true for those who are heterosexual),

the same sex (as is true for those who are lesbian or gay) or both (as is true for those

who are bisexual).

It still allows discrimination against me and others like me.

Some have heard me refer to the Schizophrenia that New mexico has about gender issues first off they enact something like this:

A. an employer, unless based on a bona fide occupational qualification or other statutory prohibition, to refuse to hire, to discharge, to promote or demote or to discriminate in matters of compensation, terms, conditions or privileges of employment against any person otherwise qualified because of race, age, religion, color, national origin, ancestry, sex, physical or mental handicap or serious medical condition, or, if the employer has fifty or more employees, spousal affiliation; provided, however, that 29 U.S.C. Section 631©(1) and (2) shall apply to discrimination based on age; or, if the employer has fifteen or more employees, to discriminate against an employee based upon the employee's sexual orientation or gender identity;

Then find it too unpalatable to legalize same sex marriage

Under the exceptions to the law stated above they put this:

Nothing contained in the Human Rights Act [28-1-1 NMSA 1978] shall:

E. apply to public restrooms, public showers, public dressing facilities or sleeping quarters in public institutions, where the preference or limitation is based on sex;

Um ok ladies, we may have a place to stand but it looks like we just lost our place to go... well this one goes to the lady's room anyway.

Sure, I am Asexual. They list others but not that. I'm not sure under what sort of circumstances I would be discriminated against, but if it happened I wouldn't be protected.

The policy doesn't explicity state "asexual," true. But it does include every form of discriminatiion

based on sexual preference or gender identity, which by inference includes identification as an asexual

person.

The way the policy is written, unless it explicity excludes a group, then that group is automatically covered.

At least that's the way I read it. So if you were a City employee, you would be covered.

Inference means very little in a court. If that were true, they wouldn't have needed to define Sexual Orientation.
