Has Anyone Received A Discharge For Transgerism?

I am interested in pursuing legal action against the VA for treatment. Any information regarding the military's position and current policy surrounding this issue will be helpful. I currently receive disability pension for depression that is not service connected. My only hope of afordable treatment is with them.

My discharge from the military stated Other Physical/Mental Condition Personality Disorder and I was given an Re-4. I was only in for 24 days so I have no VA benefits. Thank god I got on SSI/SSDI and Medicare which does pay for transition related services including SRS.

Take Care

Before you go storming the walls…

The VA has changed its policies regarding treatment of veterans who are transgendered in some (most) locations. You do have to inquire with the local VA hospital and talk to a knowledgeable patient advocate. So long as you met the requirements to receive VA benefits you should be fine. Here in the northeast they do well by everyone.

The questions;

Type of discharge; it varies greatly and is dependent upon the Commanding Officer and the under lying circumstances. The past few people that I’ve known have gotten Honorable Discharges. One was noted for psychological reasons and another was at the governments discretion.

The reenlistment codes are typically always RE4, or better known as ‘4F’, but I’ve know of one to get a RE3 recently.

If you wish to pursure legal action against the VA, please avail yourself of TAVA’s knowledge. That’s why TAVA exsists is to pursue medical treatment of trans veterans in the VA.

On a different note… RE-3U … Minority… so, you can get kicked out and banned from military service due to being a minority? Wow, aren’t we an enlightened nation.

Thank you all for your replies. I am going to an appointment in 2 weeks with my psychiatrist and will start with her. I am on disability pension and my only hope is VA treatment as I can't afford the required surgeries. The more information I have about previous government action the more pressure I can bring to bare in receiving my own care.

Surgery? Sorry, only 3 states that I know of have done that. 2 quit doing it, the third only does it on a case by case and you have to be a resident there for a while. They will see you for theapy and HRT, thats about it.

I'm sorry if I gave an impression that they do more than that.

Gina,

I wasn't mislead by you or other posts on this site as to the current state of VA treatment. I am interested in a legal case that will have national repercussions as to how our medical treatment is handled. I am not sure that an operation is right for me or is. But, I do know that it is a decision for me and my care providers to make based on the best available information, not some bureaucrats in Washington. There has been a plethora of studies over the last thirty years that strongly indicates a biological component to the phenomena and successful treatments up to and including surgery.

This needs a national trial with its national outcome. There big fear is costs and san fransisco has eliminated that as justification. A liver transplant can cost $2 million, chemotherapy can excee half a million and these are done on a regular basis. I believe that a properly argued case can prevail considering prior decisions in case law.
