New York Appeals Court Throws Out Hate Crimes Conviction

Somebody wanted fill news inches on this one. The TG hate element to this is overblown and incorrectly reported. It looks like the judge read one jury instruction, and the jury misunderstood it. The way I read this is that the jury did not find him guilty of manslaughter (primary count) but found him guilty of the hate enhancement never the less. Without the primary count, the enhancement is moot. From what I read at the minute only the firearms charge is operational. Cruddy writing all over this.
