Housing Discrimination

I have just been given 2 weeks to get out of my house because I am "gay" and a "Transgender". I am on disability for bipolar and the same person who is my landlord is also my SSDI payee. So he has total control of my money and has given me nothing to find a new place and has given me this deadline. Is there anything I can do about it? I understand that people with disabilities are protected from housing discrimination and often in some circumstances have extra protection in evictions such as additional time to relocate. I am currently too upset to look it up successfully. Anyone know where I can turn to and what options I have. I just payed my freakin' rent last week! (ok he payed my rent last week to himself).

God this is such a mess. Why do people have to hate so much?

Oh Chris - such bad news. I am not really an activist and I don't know anything about laws in your state. I am sure there is SOMETHING someone can suggest.

How awful - keep us updated - you are certainly in my prayers! I don't know how people can be so insensitive - this sounds so much like a personal attack on you!

Yech....

What is SSDI?

Also, do you have a legal aid office nearby? Sounds like you're getting screwed totally in a couple of different ways.

Please go look up your rights and the laws where you live. That's horrible. GAH! They CAN'T do this in Canada - we have so many laws againts discrimination here I'm sure it's illegal.

That can't be legal. I dunno the state flags very well, but I'd be willing to do some research on your state laws if I can figure it out.

Just run your mouse over the flag and it will show you the stat - the same thing for countries. Good luck on your research!

Yeah in Canada, we have the Charter of Rights and Liberties.

Wonderful things that guarantees protection from discrimination if ANY characteristic besides merits or a relevant characteristic (bad payer) is used against you. This includes race, sex, being trans, being LGBA (A = asexual), being intersex, having a disability, religion...

It's not always upheld as shows the Kimberly Nixon vs Vancouver Rape Relief trial, but that was concerning a more obscure clause (A group granted exemption, having the right to hire only women - the court gave it the right to decide what kind of women they could hire.)

Looked up the state in question -- Gender identity/expression isn't protected officially, and neither is sexual identity. However I suggest you talk to someone official. I don't know much about this sort of stuff yet, but maybe someone else would have an idea of who to talk to.

As a side note, how can they not even have sexual orientation protected? >_< I thought all states at least had that by now... =/

IMO Title VII should amply cover it. It's been tried before, with mixed results. I guess it really depends on the judge. Canada sees "discrimination based on sex" as including gender identity and implying sexual orientation. So being obtuse and saying "its not specifically against sex" won't float in Canada...I wonder if it can be used as a precedent?

One of the first things you should do is go to the SS office and change your pay-ee that way he can't get anymore of your money, I would do that ASAP. Secound I'm not sure but there should at least be a law to protect you because you do have a disability. I wouldn't use the gay or Transgender thing being that there isn't any law in you state that exactly protects against that. Good luck, I'll keep you in my prayers.

This is terrible news and is certainly NOT legal! He can get into some real strife with an attitude like that.

This may need to become a police matter, warn this 'land lord' of further actions and see if he can wake up to himself.

or even better, discuss this problem with his management, he will be likely to lose his job.

Gender identity and expression may not be covered but none the less, it is still a criminal offense to evict you and withhold rightful pension payments based on descrimination of someone's sexuality, gender or disability for any reasons.

Your situation is NOT within violation in regards to their contract regulations, terms and conditions!

It really is none of his business anyway. This person really sounds like a rotten sod!!

Goodness I hope this situation improves! :(

Much Luv and a big hug!

Chris - this is SO unfair it makes my blood boil. I don't have much too say that hasn't already been said by the others here but just know we are all on your side and hope it will work out for you.

I think it's worth pursuing action against this person.

Thanks everyone. To answer a few questions sex discrimination doesnt cover transsexuals (but does cover crossdressers) because of a very awkward ruling in my court of appeals district 13.

This makes me so mad I don't know what to do. I cant even think about it because I just get more upset.

The landlord is my brother and he is a school teacher who has a transsexual at his school, though not in his class. I really would like to let the superintendent (who happens to be a lesbian) know so she watch his conduct toward students, how could I go about that? I honestly think that someone with this lack of integrity and bigotry should not teach... but that is her decision. I do think she should know though.

I was saying that for Canada. I know the US are generally regressive regarding discrimination policies. Such as viewing it as narrowly as possible.

contact a lawyer immediately, pick up a phone book or go online to switchboard.com and look for local lawyers who specialize in discrimination and or disability cases.

My name is Jennifer, and used to be a part of this forum, going back to Laura's' Playground. I already know quite a few of the people here. I started transition about 15 years ago. My  gender markers are changed with Social Security and birth certificate. The reason I am returning is I believe I can help guide newer members through the pitfalls of their transitioning experience.   I lived in Arizona, and now live in Maine. And the first thing I want to emphasize is where you live can matter a lot. In Maine, I work in a hospital, and find many of my co-workers very accepting. I find the women more understanding and enjoy my journey more. Of course, this is a small sample, and your mileage may vary.    What I found as one of the most important topics when choosing a place to live. I found only one transgender doctor who understands, or is willing to monitor my HRT. But, he has stopped his regular practice and only sees some of his regular patients on Wednesday mornings. He has changed his career and teaches residents the rest of the week. He told me he wanted to teach other doctors how to work with transgender clients. This subject is woefully lacking in Medical School. I was using the transdermal patch, and we agreed to switch to estradiol valerate. He is working on more feminizing my body. I don't doubt he will be supportive when I decide to go through my surgery, hopefully next year. I will be on Medicare and they support surgery, if it is considered medically necessary.    That is enough for now, and I appreciate this site for all the help with transgender support.   Jennifer

trump only knows how to tear down and destroy. Actually doing something positive and building anything up seems to be beyond his grasp. It's such a a shame that so many people are so bent on trump's hatred and anger. Unhappy people all ☹️

We have customers real picky,I have a couple old bed sheets that I put over the seats.I order the paper floor mats that used and new car dealer use put on the floor. One customer, will complain if he sees a grease mark and knows it is not from me.

Not sure how you think that Trumps edicts will not make it through the courts. He owns them too. I can see Trump nominating Alina Habba to the Supreme Court. The Rs have already tainted the states with anti-trans legislation. Unless there is a huge blue wave in November that nobody sees coming, we will continue to be harassed. I am resigned to the fact that one day, we could be rounded up, and that is that. I would just as soon get it over with. All of the machinations about Trump breaking the law, and all of the punditry occurring in the media, is for naught. This guy has outclassed any efforts of organized crime to avoid punishment. It truly is amazing to watch how he mesmerizes members of his own party into being mindless.

Not everything Trump tries will make it through the courts.  I think Biden is blowing it big time in not trying to get trans-friendly legislation through Congress but instead he's relying on easily reversed regulations.     The DOE should be abolished. I agree. Hopefully that will happen.
    • Abigail Genevieve
Not everyone is a single issue voter.  If you are convinced Biden is destroying the country as a whole and Trump is not, you may well vote for Trump.

This should be a reminder to everybody that the president is not the legislature. Anything done by one president, can be undone by the next one. It just goes back and forth.   As for title IX, I'm against it. Not because of the protection that offers, but because I am against Federal involvement in education.  I would love to have a president and A legislature that would abolish Department of Education at the federal level. Even the states version of it is bad enough. Education is a local issue.

"Defam ation of character" means to make false statements about a person, to cause ruin to a person's reputation, which what happened to me. Your right, there is little I can do about other than visiting websites where I feel welcomed.

Yeah @Ivy pet pass doors are an open invitation for wildlife to come in.    When I had hunting dogs 20+ years ago I had a side kennel with a pet pass door so the dogs could bed down in the garage. They kept uninvited animals out while we were home. However once we went hunting the raccoons figured out they could help themselves out to a free meal and water. My wife made me put a latch on it so she didn’t have to deal with them.    Hugs   Mindy🌈🐛🏳️‍⚧️🦋

My kitty has a litter box, which she uses on occasion.  But she prefers to make me get up to led her out. I could install a "cat door" but I'm afraid it would be used more by the possums and raccoons.  I have had possums in the house more than once - even without one.
