Birth certificate

Hey all. I dont know if this is the right place for this question and if not, place move it to the right place. Can a biological parent be removed from their childs birth certificate just because the other parent wants to or because to you are transgender and they dont like it ou r you? Thanks all hugs!!!

I don't believe so. but each state has different laws about messing with a birth certificate.

I've never heard of being able to remove a parent. I know if the father is unknown at birth they can be added later or if DNA proves the father is someone else you can change it but...I don't know about removing someone.

I suppose that in law, almost anything is possible, or at least could be attempted.  But I've never heard of such a thing.  Spite or hatred is not a valid reason to ignore the parentage of a child on a birth certificate (or shouldn't be).

I’ve never heard of that before. The only case where a parent would not be on the birth certificate that I’ve heard of is when the social worker who handles the birth statistics form refuses to allow a parent to be on for a technical reason, such as not filling the form out properly in the time allowed. Or because the mother refused to acknowledge the father in the beginning. However it can be contested by DNA and a judge will usually honor the results. Removal long after the fact out of spite has no legal precedent that I know of but if it does exist then it would probably have to be because of some gross misconduct such as murder or pedophelia. Being transgender is not a good reason to do that. In fact that’s probably grounds for a discrimination suit.

Thanks all but the reason why my ex wants my name removed is because I am transgender and she considers me dead to her and my daughter and she wants her soon to be husband to adopt my child and put his name on it. That's what she wants to.do. hugs all!!!

Susan, I suggest you seek the assistance of a family lawyer.  That's your best bet.

Well here is another couple of problems.  My ex is in Washington and I am in Idaho and I dont have the money to get a family lawyer and the money to go to Washington.  But I started thinking. My daughter was born here so she would have to file it here

You can still get legal assistance and possibly even get help from transgender legal services.

try contacting them and see if they can help you. They might be able to do all the work for you pro bono or set you up with a local affiliate that will.
