Republican AGs Declare LGBTQ+ Merchandise May Be Obscene

Apparently these people are not going to let up.  Looks like it's mostly threats at this point but…

 

" Inspired by those threats, these Republican attorneys general now have issued stern warnings of potential legal repercussions to the store."

 

"Earlier this year, several states either proposed or enacted legislation classifying LGBTQ+ content as obscene…  Moreover, a number of states approved laws categorizing drag — defined by these laws as dressing and performing in a gender different from one’s assigned birth gender — as obscene."

 

It's not the content, it's the entire subject.  

To paraphrase…  They keep using that word, I don't think they know what it. means.

It is a formula and conjuring word of magik to them for political traction.  Now if they would have the same gut reaction to actual child abuse situations life would be better.  -- I am specifically referring to some adults screaming some terrible insults at their children over performance during a Little League Baseball Game which took place at the field at the end of my block the many times, and where I have taken car license plate numbers and made child welfare calls to my police department since I feared for the child's safety.

What these Republican attorneys general say is a form of Hate Speech—and THAT is obscene.

People can say what they like, but obscenity is a pretty narrow category in the law.  Given that "harmful to minors" is described beforehand by the term "prurient interest," they will have to twist the law like a pretzel to classify the entire LGBTQ+ subject as obscenity.  A certain amount of obscenity/vulgarity is considered Constitutionally protected free speech.   For example, the Supreme Court has upheld people's right to flip the bird at one another, and even to make the gesture at police. 

 

Eventually this will have to go to the Supreme Court....and that court is going to be VERY busy in the next couple of years with all of this going on.  I hope that in the end we can re-affirm free speech.  Let everybody say and show whatever they want, wherever they want, to whomever they want, at any time.  100% free.  Having any censorship at all ends up with debates and attempts at qualitative judgements of content that are inherently biased and inaccurate.  To me, the worst hate speech in the world is to tell somebody, "You can't say that."

I'm so glad you made this comment.  My biggest fear is the erosion of free speech rights.  And as much as it can hurt, I support anyone's right to say what they want, even when it comes from fear or ignorance.  I may not to like or agree with what someone says, but they are entitled to say what they will.  Of course, that doesn't mean I won't argue their alleged point, that is my own right to free speech, but to censor anyone is a dangerous course.

The actual merchandise that was aimed at children and youth, the little there was, consisted of clothing & other items with rainbows or TG pride colors.  There is NO WAY any court is going to consider that "obscene."  What they are trying to do is intimidate Target and other retailers from ever having another pride day or recognizing LGBT or Trans Pride in any way.  It might work for some retailers, but not for most, IMO. 

 

De-legitimatizing the LGBT Community isn't going to work outside of the R base, which gets its rocks off by "owning the libs."  Some polls recently have shown support for the LGBT community and our rights to be declining some, but for Americans in general it is still above 50 percent.  I won't deny that the right's pounding of us has had some effect, but it won't last. 

 

Stay strong, my friends.  We aren't going anywhere, least of all back in the closet.

Back 53 years ago in my days as a Court Clerk, Obscenity cases were rough as a dry corncob on the arresting officers and complaining witnesses. They did not prove a case just by saying they were offended, even if the law seemed to convey that notion.  Defense lawyers were quick to ask personal details of how the person actually had been affected  in detail by about what they saw or heard and quickly put their individual sex lives onto big screen in ways that truly would have been obscene if seen in any other public venue.   Asking a person if they sexually climaxed and did they show proof to an investigating police officer was fair game in those trials.  I wonder how that will pan out in this round.  The trials always took days and were costly for the prosecuting agency, especially when a not-guilty verdict came down.   Many complaining witnesses (victims???) chickened out when they found out what they were going to experience.

I'm for free speech myself.  I do have problems with threats though.  Isn't threatening someone a crime -- or am I just being a "snowflake?"  Is it free speech to dox someone?  I mean I suppose so.  How about "swatting?"   Disrupting a school board meeting?

The other thing is when discrimination is considered "free speech" -- I mean, yeah… kinda.

 

Is "free speech anything goes?

      I am concerned about what Trump will do to the transgender community. One group of his supporters are evangelical Christians. I want to emphasize that not all of these Christians are non-supportive, but there are a lot. When you add that transgender people are being singled out as a punching bag for many politicians, our lives become more in jeopardy. We need to stand up and fight back. We have a right to the same freedoms as everyone else.

      My name is Jennifer, and used to be a part of this forum, going back to Laura's' Playground. I already know quite a few of the people here. I started transition about 15 years ago. My  gender markers are changed with Social Security and birth certificate. The reason I am returning is I believe I can help guide newer members through the pitfalls of their transitioning experience.   I lived in Arizona, and now live in Maine. And the first thing I want to emphasize is where you live can matter a lot. In Maine, I work in a hospital, and find many of my co-workers very accepting. I find the women more understanding and enjoy my journey more. Of course, this is a small sample, and your mileage may vary.    What I found as one of the most important topics when choosing a place to live. I found only one transgender doctor who understands, or is willing to monitor my HRT. But, he has stopped his regular practice and only sees some of his regular patients on Wednesday mornings. He has changed his career and teaches residents the rest of the week. He told me he wanted to teach other doctors how to work with transgender clients. This subject is woefully lacking in Medical School. I was using the transdermal patch, and we agreed to switch to estradiol valerate. He is working on more feminizing my body. I don't doubt he will be supportive when I decide to go through my surgery, hopefully next year. I will be on Medicare and they support surgery, if it is considered medically necessary.    That is enough for now, and I appreciate this site for all the help with transgender support.   Jennifer

      trump only knows how to tear down and destroy. Actually doing something positive and building anything up seems to be beyond his grasp. It's such a a shame that so many people are so bent on trump's hatred and anger. Unhappy people all ☹️

      We have customers real picky,I have a couple old bed sheets that I put over the seats.I order the paper floor mats that used and new car dealer use put on the floor.One customer,will complain if he sees a grease mark and knows it is not from me.

      Not sure how you think that Trumps edicts will not make it through the courts. He owns them too. I can see Trump nominating Alina Habba to the Supreme Court. The Rs have already tainted the states with anti-trans legislation. Unless there is a huge blue wave in November that nobody sees coming, we will continue to be harassed. I am resigned to the fact that one day, we could be rounded up, and that is that. I would just as soon get it over with. All of the machinations about Trump breaking the law, and all of the punditry occurring in the media, is for naught. This guy has outclassed any efforts of organized crime to avoid punishment. It truly is amazing to watch how he mesmerizes members of his own party into being mindless.

      Not everything Trump tries will make it through the courts.  I think Biden is blowing it big time in not trying to get trans-friendly legislation through Congress but instead he's relying on easily reversed regulations.     The DOE should be abolished. I agree. Hopefully that will happen.

      Not everyone is a single issue voter.  If you are convinced Biden is destroying the country as a whole and Trump is not, you may well vote for Trump.

      This should be a reminder to everybody that the president is not the legislature. Anything done by one president, can be undone by the next one. It just goes back and forth.   As for title IX, I'm against it. Not because of the protection that offers, but because I am against Federal involvement in education.  I would love to have a president and A legislature that would abolish Department of Education at the federal level. Even the states version of it is bad enough. Education is a local issue.

      "Defam ation of character" means to make false statements about a person, to cause ruin to a person's reputation, which what happened to me. Your right, there is little I can do about other than visiting websites where I feel welcomed.

      Yeah @Ivy pet pass doors are an open invitation for wildlife to come in.    When I had hunting dogs 20+ years ago I had a side kennel with a pet pass door so the dogs could bed down in the garage. They kept uninvited animals out while we were home. However once we went hunting the raccoons figured out they could help themselves out to a free meal and water. My wife made me put a latch on it so she didn’t have to deal with them.    Hugs   Mindy🌈🐛🏳️‍⚧️🦋
