On 5 Mar, 2010 the Attorney General from the Commonwealth of Virginia, Ken Cuccinelli II, wrote a letter to all state colleges and universities telling them that it is illegal to "approve inclusion of 'sexual orientation,' 'gender identity,' 'gender expression,' " etc in their non-discrimination policies. Translation: any VA state college or university that refuses to discriminate on the basis of sexual orientation / gender identity / gender expression is breaking the law. That weekend there were protests at almost every single public higher education institution in the Commonwealth, yet as of this moment the AG refuses to rescind the remarks in his letter.

Well I'm stuck here for awhile, at least I'm going to college online. So what it is illegal for them to accept LGBT students now? I honestly am so tired of it all, I would leave the country if I had the chance.

The Attorney General is standing by his statement that VA law prohibits including sexual orientation in non-discrimination policies. In addition, the "executive declaration" the Governor gave has no real authority in Virginia, as it is not an "executive order" which is what is needed to have any actual sort of power.

Va. Governor McConnell issues order banning discrimination against gays

Virginia Gov. Bob McDonnell has issued a directive to state employees saying workplace discrimination, including bias against gays, is prohibited.

McDonnell's move Wednesday came amid widespread gay rights protests on college campuses in the week since state Attorney General Ken Cuccinelli II directed the state's public colleges and universities to remove references to sexual orientation from their non-discrimination policies, the Richmond (Va.) Times-Dispatch reported. The Republican attorney general says only the General Assembly can extend to gays legal protection against non-discrimination.

In his directive, McDonnell, a first-term Republican, said discrimination based on factors including sexual orientation violates the Equal Protection Clause of the U.S. Constitution.

So, it's a fight between the Gov. and the Atty. Gen......

What a tool I hope the judicial system puts him in his place. His place is not to interpret laws. Thats the job of the judicial system.
