This makes me mad. At least the jerk was convicted of assault. One of the things we learned in the police academy is that rape is a crime of violence, not a crime of sex. I guess this judge never got that concept. The victim is appealing.

The swede court this was settled in is a joke, most cases have to be pushed higher up to be properly handled. I actually heard about this about 3 days ago on a game I played, and the people from sweden all agreed the courts at this level are just plain bad.

All of the women agreed that TG or not, intending to commit rape to someone is intending to commit rape, and that if not held accountable for that, what do you think he'll do as soon as he's free.

"Having read the story from 3 different sources now, I don't think it's as discriminatory as they make it sound. I think what actually happened is the man sexually assaulted the victim, but - upon realising the victim had a penis - he desisted the attack, so he committed a sexual assault, but didn't technically attempt to escalate that to a rape. I think that is what is really meant. The quote from a politician saying the crime was impossible to complete is clearly ridiculous, because cis-female, cis-male, FTM and MTF people can all be raped. However, within a legal context, I don't think he attempted rape, but did commit a sexual assault. He did get 4 years for assault. It should have been deemed a SEXUAL assault though."

From the comment section. I agree with him if that is the case, though I don't know the full details of the crime or court case.

Tingsrätten (the first court) is usually quite stupid. It's like 50/50. Hovrätten (royal court) is better and has more competent judges.

If you rob a store, but they don't happen to have any money, didn't you still try and rob the store?

I agree completely. His intentions were rape and he should be judged accordingly. I forgot to add this in my first response.
