Texas Anti-Trans Bill SB 723

This bill will make it harder for many transgender Texans to marry in Texas and will make it impossible if that Texas resident hails from Idaho, Ohio, or Tennessee. Of course, that's their goal, not allowing trans people to marry at all.

Good old fashioned right wing bigotry. Oh, and notice which political party is the driving force behind this sort of nonsense, yet again?

I just read the bill and anyone from any state can show up with a valid or 2 year expired passport from any of the 50 states, even the ones that will not reissue a birth cert, and be issued a marriage license.

I've seen this before. Typical propaganda, the world is coming to the end for trans people.

It will in no way affect ability get marriage license for any practical matter.

The second link says "...would prevent people from obtaining a licence with a document that lacks photographic identification". That means nobody could use a birth certificate if I take the wording as accurate which means being unable to alter birth certificate is irrelevant.

Photo ID with appropriate gender indication can even be obtained in many instances without even having to have SRS.

Regardless of getting marriage license, has the Littleton precedent been overturned or been superseded yet cause regardless of initiating a marriage that precedent would effectively make any challenge to a marriage likely to succeed.

Anyway, this bill is a requirement that people bring a photo ID to get a marriage license. There are numerous options listed as acceptable.

The following are some of the things that are suggested to be struck that are currently allowed:

-an original or certified copy of a birth certificate

-school records

-an insurance policy continuously valid for the two prior years

-a motor vehicle certificate of title;

-military records

-a divorce decree;

-a voter registration certif

Here is a hypothetical question... a good ol boy from Bama shows up wearing a Romney shirt with a birth cert, and a post-op from San Fran wearing an Obama shirt w/a drivers license. Who do you think, according to this anti-trans bill pushed by republicans would get the marriage license?

It's not an attack on trans folk, it's a requirement to show a photo ID. A copy of a court order for a name change is not a photo ID, but a person who has a court order for name/sex change can get a photo ID to use for a marriage license.

Look through it at all the other stuff they struck, including expired Concealed Handgun Licenses. Would Texas actively target handgun licensees along with trans folk?

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subsection (, Section 2.005, Family Code, is amended to read as follows: ( The proof must be established by: (1) a driver's license or identification card issued by this state, another state, or a foreign government [Canadian province] that is current or has expired not more than two years preceding the date the identification is submitted to the county clerk in connection with an application for a license; (2) a United States passport that is current or has expired not more than two years preceding the date the passport is submitted to the county clerk in connection with an application for a license; (3) a current passport issued by a foreign country or a consular document issued by a state or national government; (4) an unexpired Certificate of United States Citizenship, Certificate of Naturalization, United States Citizen Identification Card, Permanent Resident Card, Temporary Resident Card, Employment Authorization Card, or other document issued by the federal Department of Homeland Security or the United States Department of State that contains the person's [including an identification] photograph; (5) an unexpired military identification card for active duty, reserve, or retired personnel that contains the person's [with an identification] photograph; (6) [an original or certified copy of a birth certificate issued by a bureau of vital statistics for a state or a foreign government; [(7) an original or certified copy of a Consular Report of Birth Abroad or Certificate of Birth Abroad issued by the United States Department of State; [(8) an original or certified copy of a court order relating to the applicant's name change or sex change; [(9) school records from a secondary school or institution of higher education; [(10) an insurance policy continuously valid for the two years preceding the date of the application for a license; [(11) a motor vehicle certificate of title; [(12) military records, including documentation of release or discharge from active duty or a draft record; [(13)] An unexpired military dependent identification card that contains the person's photograph; (7) an unexpired [(14) an original or certified copy of the applicant's marriage license or divorce decree; [(15) a voter registration certificate; [(16) a] pilot's license issued by the Federal Aviation Administration or another authorized agency of the United States that contains the person's photograph; (8) an unexpired [(17) a] license to carry a concealed handgun under Subchapter H, Chapter 411, Government Code; (9) [(18)] a temporary driving permit or a temporary identification card issued by the Department of Public Safety, together with an identification photograph; or (10) [(19)] an offender identification card issued by the Texas Department of Criminal Justice that contains the person's photograph. SECTION 2. The change in law made by this Act applies only to an application for a marriage license submitted to a county clerk on or after the effective date of this Act. An application for a marriage license submitted before the effective date of this Act is governed by the law in effect immediately before that date, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect September 1, 2013.

Hey there are lots of good people in Texas. Lot's of good places Heck even when I was in sulphur springs which is east texas "hillbilly hell" I never had a problem.

That said, eh who doesn't have a photo id at this point. Maybe I am just not seeing it. I don't know

I am not going to try and interpret the bill.. That's for people much smarter then me but if all this is correct.. Where is HRC, Gladd, TDL. Looks like once again, the T is forgotten and thrown under the bus by the rest of the GLB community.

Sometimes I just want to start screaming at the top of my Lungs.. NO Gay Marriage until everyone has equal rights not just the GLB.

I think sometimes that would be the only way to bring attention to the T part of our supposed group.

I know its not really feasible but it feels good to vent.. Now back to our regular scheduled life.
