Canada does not as yet have automatic asylum for trans people from the US.  As I noted above, there is a petition in the works to ask for that, but no indication that it will receive a favourable response.  You could, of course, try to immigrate through the normal channels.  Immigration Canada

 

Canada does have good protection for trans people at the federal and provincial level in all provinces and territories.  The general public are, in general, quite accepting, though we have our own trumpists lurking in the woodwork.

@KathyLaurenOh Darn Oh well thanks for the info.  I was half hoping the Petition had moved along by now : ) I'm waiting to see how my transition goes here on Medicare and then make some decisions.  Now if I could just get my hummingbirds to follow me up the Sound.  Since the US Republicans want to "Eradicate Transgenderism" it would be nice if we could find protection in Canada like from the Draft during Viet Nam.

Most Vietnam-era draft dodgers went the "unofficial resident" route.  As long as you could prove that you didn't stay in Canada longer than six months at a time, you could stay as a visitor.  Most of them would, once every six months, cross the border (risking arrest) and buy something at the nearest border town, keeping the receipt as their proof.  The rules might have changed since then, but that's how it was done.

When I was younger and in the military, I was assigned to a unit in what was then West Germany that dealt with asylum seekers and refugees. The unit was to debrief these folks, and as an incentive to get them to speak to us, we helped with their asylum and refugee paperwork. So, while not a lawyer specializing in this field, I got to be fairly proficient with the requirements for both categories and their sub-categories. A couple of caveats before I begin. First, most of the international agreements date from the post WW2 and cold war period, and have likely changed since I last worked with them. Second, due to the scope of these laws, I will be speaking in broad (VERY broad) terms. If anyone has more up to date insights, I will gladly defer to them.

 

By and large, asylum seekers had to be fleeing some sort of religious, political or ethnic persecution in their home countries and have hard evidence of that. Examples included Stalin's purges in the USSR, the tortur4e, imprisonment and killing of non-Muslims and Kurd in Iran, or the genocide perpetrated in Bosnia during their civil war. (ANd t6o clarify, despite the hyperbole the laws being passed in this country, don't count as genocide under the definition used in determining asylum.) In addition, individual countries may add their own requirements and often do. Most of Western Europe has, or had, very rigorous requirements for asylum and this included all of the countries of the Commonwealth. This also applied to immigration status.

 

Refugees were a bit different, in that, all asylum seekers were refugees, but not all refugees were  asylum seekers. Those folks could apply for immigration status to any country they wanted. This process often took years, and these poor folk languished in camps until their case were adjudicated. Being a refugee was much easier to become classified as it included such things as fleeing a war, famine, natural disaster and so on.

 

The point being that the passage of laws affecting the trans community in the US do not, if I'm remembering correctly, qualify any of any of the established criteria for either status under the terms of the treaties regarding asylum or refugees. Could these laws rise to meet the standards? Maybe. But until the camps start appearing, or we start getting shot out of hand, I don't believe it's likely. Qualifying for legal immigration to another country would be a better option, IMHO.

 

As a footnote, the media doesn't understand this nor do politicians. Both groups use the terms indiscriminately to drive4 their own agendas.

Thanks so much @KathyLaurenand @Marcie Jensen  That all sounds very complicated.  I will search on the Unofficial Resident.  And keep an eye on the Transgender Crime totals.  At least I won't waist any time on Asylum.  And it looks like I have plenty of time since the interest rates are coming down so slow.  Thankyou Girls !
